Eleven Defendants Indicted on Charges in Connection with Homicides in Buffalo

First Assistant Erie County District Attorney Michael J. Flaherty, Jr. announces that the following eleven defendants have recently been indicted for murder and/or other offenses, all in connection with homicides committed in the City of Buffalo.

30 year-old Lydell Jones, Jr., a/k/a "Baby L", a/k/a "Baby J", of 476 High Street in the City of Buffalo was arraigned in State Supreme on an indictment charging him with one count of Murder in the Second Degree and two counts of Attempted Murder in the Second Degree. It is alleged that on June 22, 2014 at 32 Pershing Street in the City of Buffalo, Jones fired several shots, killing 30 year-old Victor Hernandez, and further, that he attempted to kill two other individuals, both of whom were wounded by gunfire. If convicted of these crimes, Jones faces a maximum of 75 years-to-life in state prison.

18 year-old Rashawn Austin of 546 Stockbridge Avenue in the City of Buffalo was arraigned in Erie County Court on an indictment charging him with the Murder in the Second Degree and Criminal Possession of a Weapon in the Second Degree. It is alleged that on August 30, 2015, in the vicinity of 1 Crossman Street in the City of Buffalo, Austin murdered 28 year-old Timothy Goodwin by shooting him. If convicted of these crimes, Austin faces a maximum of 25 years-to-life in state prison.   

20 year-old German Rosado-Thomas a/k/a "Man-Man" of 142 Congress Street in the City of Buffalo, 16 year-old Alvin Marrero a/k/a "Rico" of 145 Arkansas Street in the City of Buffalo and 46 year-old Mercedes Rosado a/k/a "Mostra" of 145 Arkansas Street in the City of Buffalo, were arraigned in Erie County Court on an indictment charging Rosado-Thomas and Marrero with two counts of Murder in the Second Degree and Attempted Robbery in the First Degree.  Mercedes Rosado was charged with Robbery in the First Degree, Assault in the Second Degree and Intimidating a Witness in the Third Degree.

It is alleged that on August 17, 2015 on Arkansas Street in the City of Buffalo, defendants Rosado-Thomas and Marrero attempted to rob the victim, 54 year-old James McCloskey, who was merely walking down the street.  They struck and shot the victim, killing him. It is further alleged that on August 22, 2015, Rosado threatened a witness to the homicide and assaulted and robbed another individual who was not connected to the homicide.  If convicted of these crimes, Rosado-Thomas and Marrero each face a maximum prison sentence of 25 years-to-life, while Rosado faces a maximum of 25 years in state prison.

21 year-old George Mowers, II of 124 Gold Street in the City of Buffalo and 27 year-old Derrick Kocol of 89 Gatchell Avenue in the City of Buffalo, were arraigned in State Supreme Court on an indictment charging them with Murder in the Second Degree, Manslaughter in the First Degree and Robbery in the First Degree.  It is alleged that on March 18, 2015, in the vicinity of 117 Peck Street in the City of Buffalo, Mowers and Kocol murdered 62 year-old Patrick Dennis by beating him to death during the course of a robbery. If convicted of these crimes, Mowers and Kocol both face a maximum of 25 years-to-life in state prison. 

44 year-old Victor Irizarry of 1926 Clinton Street in the City of Buffalo was arraigned in State Supreme Court on an indictment charging him with Murder in the Second Degree and Criminal Possession of a Weapon in the Second Degree.  It is alleged that on September 12, 2015, in the vicinity of Clinton and Weaver Streets in the City of Buffalo, Irizarry murdered 28 year-old by shooting him. If convicted of these crimes, Irizarry faces a maximum of 25 years-to-life in state prison.   

22 year-old Michael Holley of 221 Sprenger Street in the City of Buffalo was arraigned in State Supreme Court on an indictment charging him with Murder in the Second Degree. It is alleged that on July 24, 2015, at 498 Riley Street in the City of Buffalo, Holley murdered 54 year-old Glendyln Kinnitt by shooting her. If convicted of this crime, Holley faces a maximum of 25 years-to-life in state prison.

23 year-old Denay Foster of 326 14th Street in the City of Buffalo was arraigned in Erie County Court on an indictment charging her with Murder in the Second Degree and Manslaughter in the First Degree.  It is alleged that on September 23, 2015, Foster murdered her 5 month-old daughter, Ver’Naylah Laventure by beating her. If convicted of these crimes, Foster faces a maximum prison sentence of 25 years-to-life in state prison.

18 year-old Bobby Price, III of 289 Northland, Buffalo, was arraigned in Erie County Court on an indictment charging him with two counts of Murder in the First Degree and Criminal Possession of a Weapon in the Second Degree. It is alleged that on November 22, 2014, in the vicinity of 269 Langfield in the City of Buffalo, Price murdered 20 year old Dominque Harris of 55 Wecker Street, Buffalo and 20 year old Naim Holt of 8 Tower Street, Buffalo, by shooting them. If convicted of these crimes, Price faces a maximum prison sentence of life without parole. 

All of the above cases were investigated by Detectives from the Buffalo Police Department Homicide Squad and presented to the Erie County Grand Jury by prosecutors from the Erie County District Attorney’s Office Homicide Bureau.

Like all defendants accused of a crime, the above defendants are all presumed innocent until proven guilty in a court of law.
