Erie County District Attorney Frank A. Sedita, III announced that 16 year-old Michael Codelia, Jr. of East Amherst pleaded guilty, as charged, to Burglary in the Second Degree before Supreme Court Justice Russell P. Buscaglia. This is the highest charge for which Codelia could have been convicted had he gone to trial.
Codelia, Jr., along with his father, Michael Codelia, Sr., burglarized a home at 9040 Transit Road in East Amherst on July 10, 2012. They were observed committing the break-in by an off-duty Amherst police officer. The Codelias fled the scene when they were confronted by the officer. Both were apprehended a short time later.
The case was successfully prosecuted by Assistant District Attorney Paul E. Bonanno. Codelia, Jr. faces a maximum sentence of 15 years in state prison when he is sentenced on April 9, 2014 before Justice Buscaglia.
Codelia, Sr. previously pleaded guilty also to Burglary in the Second Degree and is scheduled to be sentenced on April 28, 2014 before Justice Buscaglia.
