Erie County District Attorney Frank A. Sedita, III announced that 22 year old Donald Green of 18 Sweeney Street, Buffalo was sentenced before Supreme Court Justice M. William Boller to of 3½ years in state prison. Green’s sentence stems from two separate convictions.

On December 13, 2012, Green pleaded guilty, as charged, to Criminal Possession of a Controlled Substance in the 5th Degree, in connection with possessing cocaine. That was the highest charge for which Green could have been convicted had he gone to trial. Green could have received a state prison sentence but was instead granted “judicial diversion,” whereby he was entered into a treatment program for his purported drug problem.    

On March 11, 2013, less than three months are being placed in judicial diversion, Green was found to be in possession of loaded revolver after a traffic stop made by Buffalo Police officers.  The defendant claimed found the gun in a field and it was his intention to sell the revolver. On May 10, 2013, Green pleaded guilty as charged to Criminal Possession of a Weapon in the 2nd Degree, the highest charge for which he could have been convicted had he gone to trial.

Morgan was successfully prosecuted by ADA Brian D. Langenfeld and ADA Ashley Morgan-Morey.
