Erie County District Attorney Frank A. Sedita, III announced that 26 year-old Matthew Kuzdzal of 27 Albany Street, Buffalo, has been indicted by an Erie County Grand Jury with Murder in the Second Degree and Predatory Sexual Assault Against a Child. 

It is alleged that on September 15, 2013 at 27 Albany Street, Buffalo, Kuzdzal murdered 5 year-old Eain Brooks of 27 Albany Street, Buffalo, by beating him.  It is further alleged that Kuzdzal sexually assaulted the 5 year-old prior to his death.  Kuzdzal will be arraigned on November 13, 2013 at 9:30 a.m. before Supreme Court Justice Christopher Burns. 

If convicted of these crimes Kuzdzal faces a maximum prison sentence of 35 years to life.  Like all defendants accused of a crime, Kuzdzal is legally presumed to be innocent until his guilt is proven in a court of law.
