Erie County District Attorney Frank A. Sedita, III announced that 26 year old Brendon Berndt, currently an inmate at the Orleans Correctional Facility, will be arraigned at 9:30 this morning before County Court Judge Michael D’Amico on an indictment charging him with Conspiracy in the Second Degree.

It is alleged that on January 21, 2012, Berndt, who was at that time an inmate at the Gowanda Correctional Facility for a Sex Abuse in the First Degree conviction from Westchester County, agreed to pay an undercover New York State Police Investigator $10,000.00 to kill the victim of his crime.

If convicted of this crime Berndt faces a maximum prison sentence of 12-1/2 to 25 years.
