Erie County District Attorney Frank A. Sedita, III announced that 26 year-old Nicholas J. Finnegan of 63 Kenefick, Buffalo, will be arraigned at 9:30 a.m. before County Court Judge Thomas P. Franczak on an indictment charging him with Murder in the Second Degree.

It is alleged that on November 8, 2013 at 63 Kenefick in Buffalo, Finnegan caused the death of 28 year old Russ A. Ross of 1129 East Delevan Avenue, Buffalo, by propelling him from Finnegan’s second floor apartment balcony. 

If convicted of this crime Finnegan faces a maximum prison sentence of 25 years to life.  Like all defendants accused of a crime, Finnegan is legally presumed to be innocent until his guilt is proven in a court of law.
