Man Charged with Vehicular Assault After Hitting Motorcycle in Williamsville

Erie County District Attorney Frank A. Sedita, III announced that 49 year old Patrick Burke of 230 Scott Street, Buffalo, will be arraigned this morning before County Court Judge Michael Pietruszka on an indictment charging him with three counts of Vehicular Assault in the Second Degree. 

It is alleged that on June 1, 2013, Burke was intoxicated and high on cocaine while driving on Main Street in Williamsville and when turning his vehicle onto Spindrift Drive, ran into a motorcycle which was driven by 31 year old Joshua Karczewski.  Karczewski’s leg was amputated as a result of the collision. It is further alleged that Burke called 911, but refused the blood test.  A judge ordered a blood test and Burke’s blood alcohol content was .16%, which is twice the legal limit, together with cocaine.

If convicted of these crimes, Burke faces a maximum prison sentence of 4 years.
