Acting Erie County District Attorney Michael J. Flaherty, Jr. announces that 43-year-old D’Andre Turner of Buffalo has pleaded guilty before State Supreme Court Justice Penny M. Wolfgang to Criminally Negligent Homicide, Driving While Ability Impaired by the Influence of Drugs and two counts of Assault in the Third Degree for striking three people with his car. 

On June 19, 2016, the defendant was driving southbound on Moselle Street in Buffalo, when he suddenly crossed over to the northbound side of the street and struck the 3 victims, killing 7-month-old Nyree Greene and causing physical injury to 23-year-old Shannon Anderson (Nyree's mother) and 28-year-old Britney Davis (Nyree's aunt).  The defendant, who admitted being under the influence of marijuana, claimed that he was reaching down to retrieve a pen on the floor when the collision happened. 

“Marijuana can be just as dangerous to others as alcohol or controlled substances,” says acting DA Flaherty. “There is a reason why it’s still prohibited.  It has led to horrible, tragic consequences when somebody consumes marijuana and gets behind the wheel of a car.” 

Turner faces a maximum of 2-4 years in prison when he is sentenced by Justice Wolfgang on December 12, 2016 at 9:30 a.m.
