Jury Takes 12 Minutes To Convict Box Cutter Attacker

Acting Erie County District Attorney Michael J. Flaherty, Jr. announces a jury has returned a guilty verdict in the assault trial of 23-year-old Mohamed Kaba of Yonkers before State Supreme Court Justice M. William Boller.

After the three day trial, the jury deliberated only 12 minutes before convicting the former Buffalo State student of Assault in the Second Degree in the attack on another Buffalo State student.

On September 7, 2015,  Kaba started a fistfight with the victim outside the STAC (Student Apartment Complex) building on the Buffalo State campus and pulled out a box cutter slashing 23-year-old Tyrell Ganey from  St. Albans, NY at least five times.

The fight stemmed from an altercation between the defendant and the victim a few days earlier at an off-campus party.

The defendant has since been expelled from the college. The victim, who has since graduated, was left with numerous scars on his body.

Kaba faces a maximum of 7 years in prison when he is sentenced July 8, 2016 at 9:30 a.m. by Justice M. William Boller.

“College campuses should be a safe environment for learning,” says acting DA Flaherty.  “There is no legitimate excuse for walking around the college campus while armed with a weapon. Our office is committed to protecting students from violence of any form.”

Acting DA Flaherty commends the SUNY Buffalo Police Department for its assistance in the case, including Investigators Thomas Einhiple and Renee Polniak.

“The investigators working under Chief Carey performed a thorough and professional investigation which led to this just verdict,“ says acting DA Flaherty.

Assistant District Attorneys Justin T. Wallens and Stephen Earnhart prosecuted the case.
