Erie County District Attorney John J. Flynn announces that 30-year-old Andee Wright of Town of Tonawanda was arraigned this afternoon before Erie County Court Judge Susan Eagan on an indictment charging her with two counts of Murder in the Second Degree (Class “A-I” felonies).
It is alleged that on October 5, 2020, between 2:30 a.m. and 3:15 a.m., the defendant intentionally engaged in conduct that caused the death of her newborn child. It is alleged that the defendant was alone when she gave birth to a 38-week-old male infant inside of her home on Eggert Road in the Town of Tonawanda. She is accused of hitting the baby at least twice, which fractured the infant’s skull and resulted in his death.
The defendant was found in medical distress later that morning by her boyfriend who called 911. Upon further investigation, the infant was found deceased in a garbage can in the basement of the house.
The Erie County Medical Examiner’s Office determined that the infant died from blunt force trauma focally penetrating trauma of the head.
The Erie County DA’s Office requested that the defendant be held without bail. Judge Eagan set bail at $75,000.
A return court date has not been scheduled at this time.
If convicted of all charges, Wright faces a maximum of 25 years to life in prison.

The case is being prosecuted by Assistant District Attorney Ryan D. Haggerty of the Homicide Unit and Assistant District Attorney Rebecca L. Schnirel of the Domestic Violence/Special Victims Bureau.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
