Alden Man Sentenced for Leaving the Scene of Accident After Hitting Pedestrian

Erie County District Attorney John J. Flynn announces that 57-year-old Donald A. Berner of Alden was sentenced this morning before Erie County Court Judge Sheila A. DiTullio to three years of probation.

The defendant hit a pedestrian with his vehicle while driving on Ransom Road in the Town of Lancaster and left the scene without reporting the incident on November 15, 2019. The pedestrian was injured as a result. The defendant was located a short time later by Lancaster Police.

Judge DiTullio found the defendant guilty of the lesser included offense of one count of Leaving the Scene of an Incident Without Reporting, Personal Injury (Class “A” misdemeanor) following a bench trial in March 2020.

DA Flynn commends the Lancaster Police Department for their work in the investigation.

The case was prosecuted by Chief Paul J. Glascott of the Vehicular Crimes Unit.
