Erie County District Attorney John J. Flynn announces that 24-year-old Carlos J. Rosa of Buffalo pleaded guilty before Erie County Court Judge Kenneth Case to one count of Assault in the Second Degree (Class “D” felony). The defendant pleaded guilty to the felony charge on Tuesday, October 12, one week before his jury trial was scheduled to begin.

On Wednesday, January 1, 2020, at approximately 2:30 a.m., the defendant assaulted the victim by slashing him across the face with an unknown sharp object outside of a nightclub on Pearl Street in the City of Buffalo. The male victim, who did not know the defendant, suffered a large cut to the side of his face that required surgery.

Rosa faces a maximum of 7 years in prison when he is sentenced as a second violent felony offender on Thursday, December 9, 2021 at 2:00 p.m. He was remanded without bail.

Judge Case issued an order of protection on behalf of the victim.

DA Flynn commends the Buffalo Police Department for their work in the investigation.

The case was prosecuted by Assistant District Attorneys Samantha N. King and David M. Zak of the Felony Trials Bureau.
