Erie County District Attorney John J. Flynn announces that 26-year-old Khaled Khan of Buffalo was sentenced this morning before State Supreme Court Justice Paul B. Wojtaszek to a determinate sentence of 6 years in prison followed by 18 months of post-release supervision. He was sentenced today as a second felony offender.

The defendant was the subject of a joint investigation conducted by the United State Drug Enforcement Administration (DEA) Buffalo Office and the Erie County District Attorney’s Office following numerous fatal opioid overdoses that occurred between Spring and Fall 2018. The defendant is believed to have supplied a potentially deadly mixture of heroin, containing fentanyl and tramadol, to drug dealers and users in the Buffalo area.

The defendant admitted to selling an amount of fentanyl-laced heroin to the informant on two separate occasions. The crimes occurred on March 21, 2019 and April 22, 2019 at two different locations in the City of Buffalo.

Khan pleaded guilty to two counts of Criminal Sale of a Controlled Substance in the Third Degree (Class “B” felonies), the highest counts in the indictment against him, on January 5, 2022.

DA Flynn commends the DEA Buffalo Office, Erie County Medical Examiner’s Office and Erie County Central Police Services Laboratory their work in this investigation. 

The case was prosecuted by Assistant District Attorney James W. Mansour, II of the Narcotics Unit and Rachel Kranitz McPhee of the Special Victims/Domestic Violence Bureau.
