Off-Duty Deputy Pleads Guilty to Driving While Impaired

Erie County District Attorney John J. Flynn announces that 46-year-old Aaron M. Naegely of Orchard Park pleaded guilty last night before Aurora Town Justice Anthony DiFillipo, IV to one count of Driving While Impaired (New York State Vehicle & Traffic Law violation).

On Friday, October 2, 2020, at approximately 8:00 p.m., the defendant was driving an Erie County Sheriff’s Office vehicle when he crashed on Jewett Holmwood Road in the Town of Aurora. The defendant, a Sheriff’s deputy who was off-duty at the time of the incident, was found to be driving while impaired by alcohol.

Naegely was sentenced to a one-year conditional discharge and ordered to pay a $500 fine and surcharges. His driver’s license was revoked for 90 days.

DA Flynn commends the Erie County Sheriff’s Office and the East Aurora Police Department for their work in the investigation.

The case was prosecuted by Chief Paul J. Glascott of the Vehicular Crimes Bureau.
