Erie County District Attorney John J. Flynn announces that 52-year-old Eric Jones of Buffalo was arraigned yesterday morning before Cheektowaga Town Justice David Stevens on two counts of Criminal Possession of a Controlled Substance in the Third Degree, Class “B” felonies. He was also charged with a Vehicle and Traffic Law violation for an equipment violation for non-transparent windows.
It is alleged that on Monday, March 2, 2020, at approximately 1:20 p.m., Erie County Sheriff’s Office Narcotics Unit investigators initiated a traffic stop on William Street near Peoria Avenue in the Town of Cheektowaga to execute a search warrant of the defendant’s vehicle. Investigators allegedly found an ounce of cocaine inside the defendant’s jacket pocket.
Deputies, along with the Buffalo Police Department Narcotics Unit, later executed a second search warrant at the defendant’s residence on Box Avenue in the City of Buffalo. Investigators allegedly recovered an additional amount of cocaine, a half kilo of fentanyl, drug paraphernalia, and approximately $12,000 in cash.
In addition, Jones was arraigned on March 3, 2020 before Buffalo City Court Judge Betty Calvo-Torres on the following charges:
- One count of Criminal Possession of a Controlled Substance in the First Degree, a Class “A-1” felony
- Two counts of Criminal Possession of a Controlled Substance in the Third Degree, Class “B” felonies
- Two counts of Criminally Using of Drug Paraphernalia in the Second Degree, Class “B” misdemeanors
Jones is scheduled to return to Buffalo City Court on Friday, March 6, 2020 at 9:30 a.m. for a felony hearing.
He is scheduled to return to Cheektowaga Town Court on Monday, March 9, 2020 at 9:00 a.m. for a felony hearing.
Jones also has pending drug-related charges in Buffalo City Court stemming from a previous arrest. It is alleged that on November 23, 2019, at approximately 10:24 p.m., officers on routine patrol observed a vehicle parked on the wrong side of Marigold Street that was blocking a driveway. When the officers approached the vehicle, they allegedly observed the defendant sitting in the front passenger seat and smelled the odor of marijuana, which prompted a search. Officers allegedly recovered crack cocaine from the defendant’s pants and more crack cocaine packaged in small bags inside the vehicle. A scale was also allegedly found.
The defendant was arraigned on November 24, 2019 on the following charges:
- Two counts of Criminal Possession of a Controlled Substance in the Third Degree, a Class “B” felonies
- One count of Criminal Possession of a Controlled Substance in the Seventh Degree, a Class “A” misdemeanor
He is scheduled to appear before Buffalo City Court Judge Debra Givens on this matter on Wednesday, March 11, 2020 at 9:30 a.m.
If convicted on all charges, Jones faces a maximum of 36 years in prison.
DA Flynn commends the Erie County Sheriff’s Office Narcotics Unit and the Buffalo Police Department Narcotics Unit for their work in the investigation.
The case is being prosecuted by Assistant District Attorney James Mansour of the DA’s Narcotics Unit.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
