Erie County District Attorney Frank A. Sedita, III announced that 18 year old Liana Nieves of 375 Crosby Street, Kenmore, pleaded guilty, as charged, to Assault in the First Degree before Supreme Court Justice John L. Michalski. This is the highest charge for which she could have been convicted had she gone to trial.
Nieves admitted that on April 26, 2013, on Chaplin Drive in the Town of Tonawanda, she intentionally struck Madeline Silvia with her vehicle after a dispute that began over Twitter and text messaging. Nieves ran down Silvia, striking her twice with her vehicle, causing serious physical injuries to her internal organs and pelvic bone.
The case was successfully prosecuted by Assistant District Attorney Christopher M. McCarthy, who is assigned to DA Sedita’s Vehicular Crimes Bureau. Nieves faces a maximum of 25 years in state prison when she is sentenced on November 7, 2013 at 2:00 P.M. by Justice Michalski.
