A striker is anyone involved in a strike or concerted stoppage of work by employees, including stoppage by reason of the expiration of a collective bargaining agreement, any any concerted slowdown or other concerted interruption of operations by employees.

SNAP Eligibility -- 

Households with striking members shall be ineligible to participate in the SNAP program unless the household was eligible for benefits the day prior to the strike and is otherwise eligible at the time of the application. However, such a household shall not receive an increased allotment as the result of a decrease in the income of the striking member(s) of the household. Pre-strike eligibility shall be determined by considering the day prior to the strike as the day of the application and assuming the strike did not occur.

 

Eligibility and income calculation -- 

Eligibility at time of application shall be determined by comparing the striking member's income the day prior to the strike to the striker's current income and adding the higher of the two to the current income of non-striking members during the month of application. Eligibility and benefit level shall then be calculated for the month of application as for any other household.

Employees who are prevented from working by a strike but are not participating in a strike are considered non-strikers and are eligible for SNAP benefits based on current income in the household. Non-strikers include:

  1. Employees whose workplace is closed by an employer in order to resist demands of employees, such as a lockout.
  2. Employees who are unable to work as a result of striking employees, such as truck drivers unable to deliver newspapers because striking newspaper pressmen prevent newspapers from being printed.
  3. Employees who are not part of the bargaining unit on strike who do not want to cross a picket line due to fear of personal injury or death.
  4. Employees who went on strike but who are exempt from work registration, the day prior to the strike, other than those who are exempt solely on the grounds that they are employed.
  5. Employees whose jobs are no longer available becaue permanent replacements have been hired by the company. However the employees will be considered strikers until such time as their jobs are no longer available.
