e-Filing Now Mandatory
As of Tuesday, October 1, 2013, under Chapter 184 of the laws of 2012, which authorizes mandatory e-filing in Erie County Supreme Court, will continue conversion from consensual to mandatory e-filing of court matters by expanding the types of cases now required to be electronically filed. Electronic Filing of court documents is now mandatory in Erie County through the New York State Court Electronic Filing System (NYSCEF). We look forward to you electronically delivering your court and other related court documents to our office.
Erie County Clerk to Implement Mandatory e-Filing of Civil Matters
In an effort to reduce the duplication of services the Erie County Clerk's Office cases commenced by E-filing AFTER April 3, 2012 are no longer available at the Erie County Clerk's website and are available ONLY at the New York State Courts' Electronic Filing (NYSCEF) website. Papers filed AFTER April 3, 2012 in cases electronically filed prior to April 4, 2012 are available ONLY on the New York State Courts' Electronic Filing (NYSCEF) website.
E-filed cases commenced prior to April 4, 2012 that are available on both the Erie County Clerk's and the New York State Courts' Electronic Filing (NYSCEF) website will no longer be updated on the Erie County Clerk's website for any papers filed April 4, 2012-forward. The complete file will ONLY be available on the NYSCEF website.
Because not all case types are eligible for electronic filing, persons searching the public records of the Erie County Clerk's Office must search both sites to obtain records for actions or proceedings, or papers of actions or proceeding at the Erie County Clerk's Office.
