50 Years to Life For Buffalo Man Who Sexually Assaulted A 10-Year-Old

Erie County District Attorney John J. Flynn announces that 39-year-old David Rath of Buffalo has been sentenced to 50 years to life in prison by Erie County Court Judge Sheila A. DiTullio for the sexual assault of a young girl. 

In February 2017, a jury found Rath guilty of three counts of Predatory Sexual Assault Against A Child, two counts of Attempted Rape in the First Degree and one count of Endangering the Welfare of a Child. 

On May 24, 2015, Rath sexually assaulted a 10-year-old girl inside a rental storage unit on Dingens St. in Buffalo. 

Rath also signed an order of protection requiring him to have no contact with the victim until April 19, 2100. 

DA Flynn commends the Buffalo Police Department Sex Offense Squad for their thorough investigation, including Detectives Adam Stephany and Christopher Gerace. 

Assistant District Attorneys Ryan D. Haggerty and Anthony M. Rossi of the DA’s Special Victims Bureau prosecuted the case.
