Erie County District Attorney John J. Flynn announces that 26-year-old Elmarious Honeycutt of Buffalo has been arraigned before Erie County Court Judge Suzanne Maxwell Barnes on an indictment charging him with one count of Attempted Murder in the Second Degree, a Class “B” violent felony, two counts of Attempted Robbery in the First Degree, Class “C” felonies, and one count of Criminal Possession of a Weapon in the Second Degree, a Class “C” felony.

It is alleged that on Sunday, July 14, 2019, at approximately 10:45 a.m., the defendant attempted to rob two victims at gunpoint on Durham Avenue in the City of Buffalo. It is further alleged that the defendant shot one of the victims in the neck. The victim was taken to ECMC, and has since recovered from the injury.

Honeycutt is scheduled to return on Tuesday, October 1, 2019 at 9:30 a.m. He remains held without bail.

If convicted on all charges, the defendant faces a maximum of 25 years in prison.

DA Flynn commends Detective Joseph Bonner of the Buffalo Police Department Gun Violence Unit for his work in the investigation.

The case is being prosecuted by Assistant District Attorney Patrick B. Shanahan of the DA’s Tactical Prosecution Unit.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
