Erie County District Attorney John J. Flynn announces that 53-year-old Robert Agresto of Buffalo has been arraigned by Buffalo City Court Judge Amy C. Martoche on one count of Making a Terroristic Threat and six counts of Criminal Possession of a Weapon on the Third Degree.
It is alleged that the defendant left several voicemails at Buffalo City Hall against city officials and Buffalo Police officers.
Investigators recovered a rifle, a shot gun, several magazines and other military equipment from the defendant’s home in Allentown.
The defendant was remanded without bail. In addition, orders of protection were issued, which includes a stay away order from City Hall.
Agresto is scheduled to return on Thursday, June 21 at 9:30 a.m. for a felony hearing.
If convicted on all charges, Agresto faces up to 7 years in prison.
DA Flynn commends the investigative work of Detective Kenneth Agee of the Buffalo Police Department.
Assistant District Attorney Sara N. Dee of the DA’s Training/Special Projects Bureau is prosecuting the case.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
