Acting Erie County District Attorney Michael J. Flaherty, Jr. announces that 51-year-old Gabriele Ballowe of Evans has pleaded guilty before State Supreme Court Justice Christopher J. Burns to the charge of Leaving the Scene of an Incident Without Reporting Resulting in Serious Physical Injury.
On December 22, 2013, Ballowe was driving on Route 5 in Evans when she struck and killed a pedestrian, 52-year-old Barry Moss of Evans and fled the scene.
Ballowe faces 1 1/3-4 years in prison when she is sentenced on December 20, 2016 at 9:30 a.m. by Justice Burns.
“This plea was offered with the support of Barry’s family,” says acting DA Flaherty. “The families of victims often highly value the acceptance of responsibility by the person who took the life of their loved one and the knowledge that the case is over.”
DA Flaherty commends the Town of Evans Police Department, Lt. Douglas Czora, NYS Police, the FBI and investigators from his office for their collaboration and outstanding investigative work.
“This fair result was possible only because of the professional efforts of the police investigators and my Assistant District Attorneys,” says acting DA Flaherty. “The defendant would never have pleaded guilty had she believed she would have prevailed at trial.”
Assistant District Attorneys Thomas Finnerty, Paul Parisi and Nick Texido all assisted in the prosecution of this case.
