Acting Erie County District Attorney Michael J. Flaherty, Jr. announces that 51-year-old Gabriele Ballowe of Evans has been sentenced by State Supreme Court Justice Christopher J. Burns to one year in jail. 

“I give credit to Justice Burns for this fair and just sentence and for holding firm to his commitment to resolve this case this year,” says acting DA Flaherty. “The terms of the sentence are not the driving force today. Far more important to the family and us is that the defendant admitted her responsibility and has been held accountable. There is no sentence that would ever bring Barry back, and all of us know that.” 

In October, Ballowe pleaded guilty to the charge of Leaving the Scene of an Incident Without Reporting Resulting in Serious Physical Injury. 

On December 22, 2013, Ballowe was driving on Route 5 in Evans when she struck and killed a pedestrian, 52-year-old Barry Moss of Evans and fled the scene. 

“We are here today because of the tireless efforts of newly installed Chief of Police Doug Czora and his law enforcement partners within the Evans Police Department, the New York State Police, FBI and the outstanding work of my prosecutors,” says acting DA Flaherty. “Everyone worked so hard.  The case is finally over.”
