Erie County District Attorney John J. Flynn announces that 38-year-old Jose Nazario of Buffalo pleaded guilty before Erie County Court Judge Sheila A. DiTullio to three counts of Criminal Sale of a Controlled Substance in the Third Degree and one count of Criminal Possession of a Controlled Substance in the Third Degree, all class “B” felonies. These are the highest charges that the defendant could have been convicted of if the case had gone to trial.

The defendant admitted to selling heroin to an undercover narcotics officer on three different dates.

Following the heroin sales, narcotics officers from the Buffalo Police Department and the Erie County Sheriff’s Office executed a search warrant at the defendant’s home on West Tupper Street. Once inside, investigators recovered 25 grams of heroin.

Nazario faces a maximum of 36 years in prison when he is sentenced on Thursday, July 26 at 9:30 a.m.

DA Flynn commends the investigative work by the narcotics officers from both the Buffalo Police Department and the Erie County Sheriff’s Office.

Assistant District Attorney James W. Mansour, II of the DA’s Narcotics Bureau prosecuted the case.
