Erie County District Attorney John J. Flynn announces that 23-year-old Robert McBride of Buffalo has been arraigned before State Supreme Court Justice Paul B. Wojtaszek on an indictment charging him with two counts of Attempted Murder in the First Degree, Class “A-1” felonies, one count of Criminal Possession of a Weapon in the Second Degree, a Class “C” felony, and one count of Reckless Endangerment in the First Degree, a Class “D” felony.

It is alleged that on April 4, 2019, at approximately 4:30 a.m., Buffalo Police officers were on routine patrol in the vicinity of Lang and Newburgh Avenues when a resident told the officers that he heard a shot fired in the area after witnessing a man attempting to break into his daughter’s vehicle.

A short time later, the officers allegedly approached the defendant, who matched a description of the suspect provided by the resident, nearby on Courtland Avenue. It is further alleged that the defendant began shooting at the officers before fleeing the scene. Neither officer was injured by gunfire.

On April 8, 2019, at approximately 3:00 p.m., Buffalo Police arrested the defendant at a relative’s home on Kensington Avenue.

McBride is scheduled to return on Monday, June 17, 2019 at 9:30 for a motion argument. He remains remanded without bail.

If convicted on all charges, he faces a maximum possible sentence of 40 years to life in prison.

The case is being prosecuted by Assistant District Attorneys Patrick B. Shanahan and Ryan D. Haggerty of the DA’s Tactical Prosecution Unit.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
