Erie County District Attorney John J. Flynn announces that 44-year-old Jeffrey Brown of Buffalo has been sentenced by Erie County Court Judge Michael Pietruszka to a determinate sentence of 17 years in prison followed by 5 years of post-release supervision.

On July 3, 2016, the defendant shot his estranged wife’s boyfriend, 46-year-old David Brown, on Marne Road in the Town of Cheektowaga. The victim died from his injuries the following morning.

In January 2018, Brown, a second felony offender, pleaded guilty to Manslaughter in the First Degree for the crime.

Last week, Brown was sentenced by U.S. District Judge Lawrence J. Vilardo to serve 10 years in federal prison. He was convicted of conspiracy to possess with intent to distribute 100 grams of more of heroin in an unrelated case. His federal sentence will be served concurrent to his state sentence.

DA Flynn commends Lt. Ken Rusin, Det. Chris Chojnacki and Det. Joseph Bauman of the Cheektowaga Police Department for their investigative work and the U.S. Attorney’s Office of the Western District for their cooperation.

“Our office worked closely with the U.S. Attorney’s Office on the case against Mr. Brown, and I am pleased that this violent offender will now face significant amount of time in both federal and state prison for his crimes,” said DA Flynn. “Our offices will be working closely together in the future to combat violent crimes committed in the City of Buffalo. We are committed to getting these criminals off the streets and bringing justice to the families affected by recent tragedies.”

The case was prosecuted by Assistant District Attorney Michael D. Smith of the DA’s Homicide Bureau and Assistant District Attorney James M. Marra of the DA’s Felony Trials Bureau.
