Erie County District Attorney John J. Flynn announces that 44-year-old Jason E. Talley of Buffalo was sentenced this morning before Erie County Court Judge James Bargnesi to 6 years in prison followed by 5 years of post-release supervision. He was sentenced today as a second violent felony offender.
During the early morning hours of October 25, 2021, the defendant hit an adult female victim in the face with a BB gun. The crime occurred in the Town of Eden while the defendant was inside of the victim’s vehicle. The defendant then drove the victim to a home in the Village of Falconer where he forced her inside. Officers from the Town of Ellicott Police Department located the defendant and victim inside of the home. The victim was taken to a hospital where she was treated for cuts and bruises to her face. Police found the BB gun, used by the defendant to hit the victim, hidden in the ceiling of the home.
Judge Bargnesi found Talley guilty of one count of Assault in the Second Degree (Class “D” felony) on October 3, 2022, rendering his decision after a four-day, non-jury trial. The defendant was acquitted of the other counts in the indictment against him.
Today, Judge Bargnesi issued a final order of protection on behalf of the victim, which remains in effect until December 2036.

The case is being prosecuted by Assistant District Attorney Rebecca L. Schnirel of the Major Crimes Unit and Assistant District Attorney Noha A. Elnakib of the Special Victims/Domestic Violence Unit.
