Erie County District Attorney John J. Flynn announces that 21-year-old Justyn Caver of Buffalo has been sentenced by State Supreme Court Justice M. William Boller to 6 months in jail and 5 years’ probation.

The defendant pleaded guilty in December to Vehicular Assault in the Second Degree, a class “E” felony, and a misdemeanor charge of DWAI.

On May 2, 2018, Caver was driving his vehicle north on Niagara Falls Blvd in Amherst when he drove onto the sidewalk and struck the victim.  The victim was walking on the sidewalk.   The defendant’s vehicle struck a road sign and his left front bumper struck the victim in the leg, and then the victim struck the windshield and was thrown onto Niagara Falls Blvd approximately 80 feet from the impact. The victim suffered serious physical injuries including a fractured leg and a skull fracture.

A Drug Recognition Evaluation determined the defendant was under the influence of Cannabis. After providing a blood sample, the Forensic Toxicology Laboratory confirmed the defendant had a high level of marijuana in his system.

The case was prosecuted by Paul J. Glascott, Chief of the DA’s Vehicular Crimes Bureau.
