Erie County District Attorney John J. Flynn announces that 29-year-old Phillip L. Jackson, Jr. of Buffalo was sentenced this morning before State Supreme Court Justice Paul B. Wojtaszek. He received an indeterminate sentence of 2 1/3 to 7 years in prison.

On November 17, 2021, at approximately 10:45 p.m., the defendant was driving a vehicle when he hit a pedestrian on the 200 block of Ludington Street in the City of Buffalo. The victim, 43-year-old Edwin Wesolowski, III of Cheektowaga, died from his injuries at the scene. The defendant drove away without reporting the incident to police.

Jackson pleaded guilty to one count of Leaving the Scene of an Incident Resulting in Death (Class “D” felony) and one count of Criminally Negligent Homicide (Class “E” felony), the highest sustainable charges, on October 26, 2022.

As part of the sentence, Justice Wojtaszek revoked the defendant’s driver’s license.

DA Flynn commends the Buffalo Police Department Accident Investigation Unit for their work in the investigation.

The case was prosecuted by Chief Paul J. Glascott of the Vehicular Crimes Unit.
