Buffalo Man Sentenced for Raping Underage Victim

Erie County District Attorney John J. Flynn announces that 44-year-old Jose Pratts of Buffalo has been sentenced by Erie County Court Judge Suzanne Maxwell Barnes to a determinate sentence of 15 years in prison followed by 10 years of post-release supervision. The defendant will be required to register as a sex offender upon his release.

The defendant admitted that in December 2016, he engaged in sexual intercourse with a victim under the age of 13 at a location in the City of Buffalo.

On September 5, 2018, Pratts pleaded guilty to one count of Rape in the First Degree, a Class “B” violent felony.

Pratts was sentenced as a second violent felony offender for his prior conviction of Attempted Robbery in the Second Degree in 2010.

DA Flynn commends Detective Mark Costantino of the Buffalo Police Department Sex Offense Squad and Victim Advocate Nicole Haffa of the Erie County DA’s Office for their work in this investigation.

The case was prosecuted by Assistant District Attorneys Meghan E. Leydecker, Anthony M. Rossi and Bethany A. Solek of the DA’s Special Victims Bureau.
