Erie County District Attorney John J. Flynn announces that 23-year-old Elijah Turley of Buffalo has been sentenced by State Supreme Court Justice Christopher J. Burns to an indeterminate sentence of 2-4 years. Also, Justice Burns issued a restitution order for State Farms Insurance for $67,624.89.

In the early morning hours of September 29, 2017, Amherst Police officers were dispatched to investigate possible vehicle racing on Niagara Falls Boulevard. The defendant, who was operating a pickup truck, refused to stop and proceeded westbound on Kenmore Avenue at a rate of 99 mph in a 35 mph zone for over three miles.

Turley lost control of the pickup truck and struck two houses on Kenmore Avenue, causing significant damage. His female passenger was ejected from the vehicle and suffered serious injuries.

The defendant, a second felony offender, pleaded guilty to Reckless Endangerment in the First Degree in February 2018.

Assistant District Attorney Kelley A. Omel of the DA’s Special Investigations Bureau prosecuted the case.
