Erie County District Attorney John J. Flynn announces that 23-year-old Killian Martin of Hamburg has been sentenced by State Supreme Court Justice Deborah A. Haendiges to 10 years in prison followed by 5 years of post-release supervision.

The defendant admitted that on June 22, 2018, while on probation, he unlawfully entered a home on Stanley Street in the City of Buffalo by removing a screen and climbing through a bathroom window. The defendant stole three sets of keys from inside the home and fled in the homeowner’s blue Honda CRV.

Shortly after midnight on July 1, 2018, a Buffalo Police officer recognized the blue Honda CRV and pursued the vehicle. In an effort to evade police, the driver of the stolen vehicle sped through a traffic light at the intersection on Broadway and Peck Street where it collided with another vehicle. The driver of the CRV, who matched the description of the defendant, fled on foot. The driver of the other vehicle suffered a broken femur and the passenger was also injured.

The defendant also admitted to burglarizing a home on McKinley Parkway on July 5, 2018, which he entered by climbing through a bedroom window. The defendant stole electronics, jewelry, clothing and alcohol. The defendant admitted that he attempted to pawn some of the items.

When the defendant was apprehended on July 8, investigators found him in possession of an EBT card that was stolen along with other items from a home on William Street in the City of Buffalo.

Martin pleaded guilty three counts of Burglary in the Second Degree, one count of Leaving the Scene of an Incident Resulting in Injury and one count of Unauthorized Use of a Motor Vehicle in September 2018.

The case was prosecuted by Assistant District Attorney Louis C. Mussari of the DA’s Special Investigations and Prosecutions Bureau.
