Erie County District Attorney John J. Flynn announces that 36-year-old Cabe Cabe of Buffalo pleaded guilty this morning before Erie County Court Judge James Bargnesi to one count of Forgery in the Third Degree (Class “A” misdemeanor).
The defendant admitted to submitting a forged New York State pistol permit application on September 27, 2019. An investigation uncovered that the defendant falsified the signatures of multiple references on the application.
Cabe faces a maximum of one year in jail when he is sentenced on Thursday, June 10, 2021 at 10:00 a.m. He remains released on his own recognizance.
“If you submit a falsified pistol permit application, you are attempting to illegally obtain a firearm and you will be prosecuted by this office,” said Erie County District Attorney John Flynn. “I want to commend the County Clerk’s Office and the Sheriff’s Office for bringing this matter to our attention.”
“As a strong supporter of the Second Amendment and gun ownership rights, I encourage responsible citizens, if they wish to do so, to exercise their right and apply for a pistol permit,” said Erie County Sheriff Timothy Howard. “However, anyone who is willing to falsify their application proves they are not a responsible gun owner and should not be granted a pistol permit. The Pistol Permit Office did a great job investigating the applicant’s permit then working with the DA’s office to bringing this issue to a legal resolution.”
“I want to commend the great work of the Erie County Sheriff’s Office and the District Attorney. The investigation of pistol permit applicants is paramount to ensuring the Licensing Officer has the best available information to determine whether an individual can responsibly handle this very serious responsibility,” said Erie County Clerk Michael P. Kearns.
DA Flynn also commends DA’s Office Confidential Criminal Investigator Natalie Perez for her work in the investigation.
The case is being prosecuted by Assistant District Attorney Brian P. Dassero of the DA’s Special Investigations and Prosecutions (SIP) Bureau.
