Erie County District Attorney John J. Flynn announces that 22-year-old David A. Douglas of Buffalo was arraigned on Saturday morning before Buffalo City Court Judge Lenora Foote-Beavers on the following charges:
- Two counts of Attempted Murder in the First Degree (Class “A-II” felonies)
- One count of Robbery in the First Degree (Class “B” felony)
- One count of Criminal Possession of a Weapon in the Second Degree (Class “C” felony)
- One count of Robbery in the Second Degree (Class “C” felony)
- Two counts of Assault in the Second Degree (Class “D” felonies)
It is alleged that on July 4, 2021, at approximately 12:35 a.m., the defendant, while aided by another unknown individual, attempted to commit a robbery outside of a restaurant on Ellicott Street in the City of Buffalo. The defendant is accused of firing multiple shots from an illegal gun in the course of committing the crime. Three victims were hit by gunfire and taken to area hospitals in civilian vehicles with non-life threatening injuries.
Douglas is scheduled to return on Thursday, July 22, 2021 at 9:30 a.m. for a felony hearing. He was remanded without bail.
If convicted of all charges, Douglas faces a maximum of 25 to life years in prison.

The case is being prosecuted by Assistant District Attorney John P. Gerken, Jr. of the Tactical Prosecution Unit.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
