Erie County District Attorney John J. Flynn announces that 57-year-old Mark Dublino of Cheektowaga was sentenced this morning before State Supreme Court Justice Paul B. Wojtaszek to a determinate sentence of 7 years in prison and 3 years post-release supervision, the maximum allowed, to be served consecutively to his current sentence.

On Friday, March 9, 2018, at approximately 10:30 a.m., the defendant attacked his defense attorney during a scheduled meeting inside the Erie County Holding Center on Delaware Avenue in the City of Buffalo. The defendant punched the victim in the face numerous times before Erie County Sheriff’s deputies were able to intervene. The attorney suffered significant facial injuries.

Wojtaszek found the defendant guilty of one count of Assault in the Second Degree (Class “D” violent felony). The defendant was convicted of the highest count in the indictment against him following a seven-day bench trial in Spring 2021.

“This defendant attacked his defense attorney while receiving legal advice in a criminal matter. His violent actions are completely unacceptable,” said Erie County District Attorney John J. Flynn.

Dublino is currently serving a sentence of 107 years in prison after a jury convicted him of two counts of Attempted Murder in the Second Degree and numerous felony charges in a separate case for attacking his ex-girlfriend and two other people in June 2016.

The case was prosecuted by Assistant District Attorneys James Marra and Nicholas A. Bussi of the DA’s Felony Trials Bureau.
