Erie County District Attorney John J. Flynn announces that Erie County Court Judge James Bargnesi has found 31-year-old Rodney Nevins of Buffalo guilty of one count of Criminal Possession of a Controlled Substance in the Third Degree, a Class “B” felony, one count of Obstructing Governmental Administration in the Second Degree, a Class “A” misdemeanor, and two counts of Criminally Using Drug Paraphernalia in the Second Degree, Class “A” misdemeanors. The defendant was found guilty of the highest count in the indictment against him following a two-day bench trial.

On October 2, 2018, at approximately 9:30 p.m., parole officers were conducting a routine search at the defendant’s home on Abbott Road in the City of Buffalo when they located a bag containing more than half an ounce of fentanyl as well as a scale and packaging materials inside the defendant’s vehicle. When the officers attempted to handcuff the defendant, he resisted and attempted to flee.

Nevins, who has a prior felony conviction, faces a maximum of 12 years in prison when he is sentenced on Tuesday, October 8, 2019 at 9:30 a.m. He remains held without bail.

DA Flynn commends New York State Division of Parole for their work in the investigation, including Officers Sean McPartland and Lindsey Cortes.

The case was prosecuted by Assistant District Attorney Frank A. Strano and Chief Paul J. Williams, III of the DA’s Narcotics Unit.
