Erie County District Attorney John J. Flynn announces that a jury has found 33-year-old Deshawn Whims of no permanent address guilty, as charged, on one count of Criminal Possession of Marijuana in the First Degree, a Class “C” felony. The defendant was convicted on the only charge in the indictment against him.
On April 12, 2018, members of the Erie County Sheriff’s Office executed a search warrant at an apartment in Bennett Village Terrace in the City of Buffalo. In the basement of the apartment, investigators found a duffle bag containing 42 pounds of marijuana packaged in freezer bags.
Whims faces a maximum of 5 ½ years in prison when he is sentenced by State Supreme Court Justice M. William Boller on Tuesday, March 26, 2019 at 9:30 a.m. The defendant remains remanded without bail.
DA Flynn commends members of the Erie County Sheriff’s Office Narcotics Unit and the Department of Homeland Security for their work in the investigation.
The case was prosecuted by Paul J. Williams, III, Chief of the DA’s Narcotics Unit, and Assistant District Attorney Gina M. Gramaglia of the DA’s Justice Courts.
