Erie County District Attorney John J. Flynn announces that 53-year-old Kyle G. Mitchell of Lancaster was sentenced yesterday morning by Erie County Court Judge Sheila A. DiTullio to a determinate sentence of 6 months in jail followed by 5 years of post-release supervision.

On December 5, 2017, at approximately 11:20 p.m., a resident returned to his home on Newell Avenue in the Village of Lancaster and found that the kitchen window had been broken. The homeowner reported that a sum of cash was missing from a cabinet. Detectives from the Lancaster Police Department collected blood evidence from the counter under the window and throughout the home, which was submitted to the Central Police Services lab. The defendant was linked to the crime through DNA analysis.

Mitchell pleaded guilty to one count of Attempted Burglary in the Second Degree, a Class “D” felony, on November 30, 2020.

DA Flynn commends the Lancaster Police Department and the Central Police Services Laboratory for their work in the investigation.

The case was prosecuted by Assistant District Attorney Brian D. Langenfeld of the DA’s Tactical Prosecution Unit.
