Erie County District Attorney John J. Flynn announces that 34-year-old Mark Hicks of North Tonawanda has been arraigned before Town of Tonawanda Judge Daniel T. Cavarello on one count of Leaving the Scene of a Serious Physical Injury Incident without Reporting, an E felony.

It is alleged that on Friday, February 16, 2018, at approximately 5:50 p.m., the defendant was driving a pickup truck on Vulcan Street near Rosedale Street in the Town of Tonawanda when he struck a 56-year-old man in a motorized wheelchair, and left the scene.

The victim spent several weeks at ECMC to be treated for injuries to his head and chest.

Hicks is scheduled to return on Thursday, August 9 at 4:30 p.m. for a felony hearing. He is being held on $10,000 cash or $25,000 bond.

If convicted on the charge, Hicks faces a maximum of 4 years in prison.

District Attorney Flynn commends the investigative work of DA’s Office Investigators Charles Danzi and Mike Wright as well as Officer Brian Ienco and Detective Nikolaos Salonikis of the Town of Tonawanda Police Department. 

Assistant District Attorney Christopher M. McCarthy of the DA’s Vehicular Crimes Bureau is prosecuting the case.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
