Erie County District Attorney John J. Flynn announces that State Supreme Court Justice Russell P. Buscaglia has found 19-year-old Josue Bermudez of Buffalo guilty of one count of Murder in the Second Degree, a Class “A-I” felony, two counts of Attempted Murder in the Second Degree, Class “B” felonies, and one count of Criminal Possession of a Weapon in the Second Degree, a Class “C” felony. Justice Buscaglia rendered his decision today following a bench trial that began on November 1, 2019.

On March 8, 2019, at approximately 9:30 p.m., the defendant fatally shot 17-year-old Deron Allen with an illegal pistol in the vicinity of the North Buffalo Community Center on Sanders Road in the City of Buffalo. Two other teenagers were injured by gunfire, but recovered from their injuries.

Bermudez faces a maximum of 75 years to life in prison when he is sentenced on Wednesday, January 29, 2020 at 11 a.m. He remains held without bail.

DA Flynn commends the investigative work by the Buffalo Police Department, including Detective Sgt. Carl Lundin, Detective Adam Stephany and Detective Joy Jermain.

The case was prosecuted by Assistant District Attorney Ashley M. Morgan of the DA’s Homicide Bureau and Assistant District Attorney Rachel L. Newton of the DA’s Felony Trials Bureau.
