Erie County District Attorney John J. Flynn announces that 16-year-old Aaron Gallon of Buffalo and 14-year-old Larry Durham, Jr. of Buffalo have been arraigned by Erie County Court Judge Sheila A. DiTullio on an indictment charging them with Attempted Murder in the Second Degree, Gang Assault in the First Degree and three counts of Assault in the First Degree. 

16-year-old Armontae Moss of Buffalo was arraigned on the same charges on January 10, 2017 by Judge DiTullio. 

It is alleged that on September 22, 2016 at 5:45 a.m. at Ellicott and Broadway, the defendants stomped a 64-year-old man causing severe physical injuries, including head trauma and skull fractures. 

The trio pleaded not guilty and bail was set for each defendant at $100,000. If convicted of the charges, Gallon and Moss face up to 25 years in jail.  Durham faces a maximum of 10 years in jail. 

DA Flynn commends the Buffalo Police Homicide squad for its thorough investigation, including Detectives Daniel Redmond, Mark White and Scott Malec and Sgt. William Cooley. DA Flynn also credits the work of the NFTA Police Department. 

Paul Parisi, Chief of the Tactical Prosecution Unit and Assistant District Attorney Katharine L. Lavin are prosecuting the case. 

As are all defendants accused of a crime, the defendants are presumed innocent until proven guilty in a court of law.
