West Seneca Man Sentenced for Sexual Conduct Against a Child

Erie County District Attorney John J. Flynn announces that 33-year-old David Moretto of West Seneca was sentenced by Erie County Court Judge Sheila A. DiTullio to 10 years in prison followed by 20 years of post-release supervision.

In February 2018, the defendant pleaded guilty to one count of Course of Sexual Conduct Against a Child in the First Degree.

In March 2017, Moretto was arrested by West Seneca Police for engaging in sexual acts with an underage female over the course of two years.

Judge DiTullio, after hearing from both the victim and the defendant, stated, “The criminal justice system will always respond strongly, firmly and swiftly to adults like you that sexually abuse children. This case demands and cries out for justice for a kid, for all kids, and this Court will clearly respond since you are vicious and violent, you’re clearly, Mr. Moretto, a pedophile, you’re not a veteran. You’re a pedophile.”

DA Flynn commends the victim and her family for their bravery and perseverance in coming forward. DA Flynn also acknowledges Detective Leitzel of the West Seneca Police Department and Nicole Haffa, victim advocate of the Special Victims Bureau.

Assistant District Attorneys Bethany A. Solek and Anthony M. Rossi of the DA’s Special Victims Bureau prosecuted the case.
