Erie County District Attorney John J. Flynn announces that 34-year-old Mark Hicks of Amherst has been sentenced by State Supreme Court Justice Paul B. Wojtaszek to 1 year in jail.

On Friday, February 16, 2018, at approximately 5:50 p.m., the defendant admitted that he was driving a pickup truck on Vulcan Street near Rosedale Street in the Town of Tonawanda when he struck a 56-year-old man in a motorized wheelchair, and left the scene. The victim spent several weeks at ECMC to be treated for injuries to his head and chest.

Hicks pleaded guilty, as charged, to one count of Leaving the Scene of a Serious Physical Injury Incident without Reporting, an “E” felony, in August 2018.

District Attorney Flynn commends the investigative work of DA’s Office Investigators Charles Danzi and Mike Wright as well as Officer Brian Ienco and Detective Nikolaos Salonikis of the Town of Tonawanda Police Department. 

The case was prosecuted by Assistant District Attorney Christopher M. McCarthy of the DA’s Vehicular Crimes Bureau.
