Drunk Driver Sentenced for Causing Wrong-Way Crash on Kensington Expressway

Erie County District Attorney John J. Flynn announces that 30-year-old Rodney Borden, Jr. of Buffalo has been sentenced by Erie County Court Judge Kenneth Case to an indeterminate sentence of 1 to 3 years in prison.  

On October 15, 2018, at approximately 11:30 p.m., the defendant, while under the influence of alcohol, was driving a vehicle the wrong way on the inbound Kensington Expressway/Route 33 near Locust Street in the City of Buffalo when he crashed head-on with another vehicle.  

The female driver was treated at ECMC, and she continues to recover from the serious injuries she suffered as a result of the crash.

Borden pleaded guilty to one count of Vehicular Assault in the First Degree, a Class “D” felony, on Thursday, June 6, 2019.

DA Flynn commends Officer Mark Andrzejak of the Buffalo Police Department Accident Investigation Unit for his work in the investigation.

The case was prosecuted by Assistant District Attorney Christopher M. McCarthy of the DA’s Vehicular Crimes Bureau.
