East Aurora Woman Pleads Guilty to Vehicular Assault for Crash That Injured Child

Erie County District Attorney John J. Flynn announces that 30-year-old Erin Kuntz of East Aurora pleaded guilty before Erie County Court Judge Susan Eagan to one count of Vehicular Assault in the First Degree, a Class “D” felony. She pleaded guilty to the highest sustainable charge.

On Sunday, July 21, 2019, at approximately 6:30 p.m., the defendant was driving a vehicle while under the influence of alcohol on East Main Street in the Village of East Aurora when she attempted to drive around a parked vehicle then struck a 9-year-old female who was on the sidewalk. The defendant was found to have a .20% BAC at the time of the crash.

The child was taken by ambulance to Oishei Children’s Hospital of Buffalo to be treated for serious physical injuries. The victim has since recovered.

Kuntz faces a maximum of 7 years in prison when she is sentenced on Monday, February 24, 2020 at 9:30 a.m. She was released on her own recognizance.

DA Flynn commends Lt. Dustin Waldron from the East Aurora Police Department for his work in the investigation.

The case was prosecuted by Chief Paul Glascott of the DA’s Vehicular Crimes Bureau.
