Niagara County Man Arraigned for Driving Drunk and Injuring Another Driver in Newstead Crash

Erie County District Attorney John J. Flynn announces that 50-year-old Mark S. Printup of Town of Cambria was arraigned last night before Newstead Town Court Justice Dennis Freeman on one count of Vehicular Assault in the Second Degree (Class “E” felony), one count of Aggravated Driving While Intoxicated and one count of Driving While Intoxicated (Class “A” misdemeanors). The defendant was also charged with two Vehicle and Traffic Law infractions for failure to stop at a stop sign and failure to yield right-of-way at an intersection.

It is alleged that on August 13, 2022, at approximately 10:42 p.m., the defendant was under the influence of alcohol when he drove his vehicle through a stop sign at Utley Road and Hunts Corners Road in the Town of Newstead, causing a collision with another vehicle that had the right-of-way at the intersection.

The driver of the other vehicle, a 21-year-old man from North Tonawanda, was extracted out of his vehicle by a local fire company. He was transported by Mercy Flight to ECMC where he remains hospitalized with serious physical injuries.

Printup was released on his own recognizance as the charges are non-qualifying offenses for bail. The matter has been waived to the Grand Jury. A return court date has not been scheduled at this time.

If convicted of the highest charge, Printup faces a maximum sentence of 4 years in prison.

DA Flynn commends the Erie County Sheriff’s Office for their work in this investigation.

The case is being prosecuted by Assistant District Attorney Christopher M. McCarthy of the Vehicular Crimes Unit.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
