West Valley Man Sentenced for Menacing Deputies Outside Springville Convenience Store

Erie County District Attorney John J. announces that 35-year-old Nicholas Krencik of West Valley, has been sentenced by State Supreme Court Justice M. William Boller to a determinate sentence of 10 years in prison followed by 5 years of post-release supervision. The defendant was sentenced as a second violent felony offender.

The defendant admitted that on Sunday, August 5, 2018, at approximately 10:20 p.m., he entered the Country Fair store on Route 39 and South Cascade Drive in the Village of Springville armed with a loaded, shortened shotgun.

As he exited the store, the defendant was ordered by two Erie County Sheriff’s Office deputies to drop his weapon, which was captured on video. Despite several orders to stop and drop his weapon, the defendant continued to approach the deputies. Both deputies fired simultaneously upon the defendant who was subsequently shot. The defendant was taken to ECMC where he was treated for non-life threatening injuries.

Krencik pleaded guilty, as charged, to two counts of Menacing a Police Officer, a Class “D” violent felony, and one count of Criminal Possession of a Weapon, a Class “C” violent felony, in April 2019.

DA Flynn commends the Erie County Sheriff’s Office deputies who responded to the incident and assisted in the investigation.

The case was prosecuted by Assistant District Attorney Ryan D. Haggerty of the DA’s Tactical Prosecution unit.
