Three Charged in Attempted Murder and Perjury Case of a U.S. Army Private

Erie County District Attorney Frank A. Sedita, III announced that 22 year old Kevin Miller, a/k/a “Booker” was arraigned this morning before County Court Judge Sheila A. DiTullio on a sealed indictment charging him with Attempted Murder in the Second Degree, Assault in the First Degree, and Criminal Possession of a Weapon in the Second Degree. Also arraigned before Judge DiTullio, were 20 year old Keyon Miller and 41 Monique Wirt, on a sealed indictment charging both with Perjury. It is alleged that on January 1, 2013, Kevin Miller, while brandishing an illegally possessed handgun and with the intent to kill Pvt. 1st Class Maynard Vanever (U.S. Army), shot the serviceman, causing serious physical injury to him. It is further alleged that Keyon Miller (Kevin Miller’s brother), and Monique Wirt (Kevin Miller’s aunt), offered false and misleading testimony on behalf of Kevin Miller. If convicted of these crimes, Kevin Miller faces a maximum prison sentence of 40 years, Keyon Miller faces a maximum prison sentence of 7 years, and Monique Wirt faces a maximum prison sentence of 1 year.
