The Erie County Department of Environment and Planning offers a program for small businesses, school districts, municipalities and agencies to dispose of hazardous waste in a cost-effective and environmentally proper manner.
Conditionally Exempt Small Quantity Generators (CESQG) must meet the following requirements (see 40 CFR § 261.5 and 6 NYCRR Part 371):
- A generator is a conditionally exempt small quantity generator in a calendar month if (s)he generates no more than 100 kilograms of hazardous waste in that month or 1 kilogram (~2.2 #) or less per month of acutely hazardous waste (listed in 40 CFR §§261.31, 261.32, or 261.33(e));
- A generator must determine if their waste is hazardous according to 40 CFR 262.1 and may accumulate hazardous waste on-site indefinitely provided that the total amount of waste accumulated does not exceed 1,000 kilograms at any one time;
- A generator must ensure that hazardous waste is delivered to a person or facility who is authorized to manage it.
Participants must pre-register and agree to the disposal fees which are based on the quantity and type of waste material. Participants are also responsible for their own transportation of the waste to the drop-off site.
