Legislator Savage’s Local Law Restricting Electronic Cigarettes is Approved

Legislature Passes Measure Prohibiting Vaping in Indoor Public Places in Erie County

Buffalo, NY- At the regular session of the Erie County Legislature held on February 26, 2015, the Legislature approved by a vote of 9-1, a Local Law sponsored by Legislator Peter Savage (D-Buffalo and Tonawanda), restricting the use of electronic cigarettes and “vaping” in indoor public places in Erie County that are already smoke-free.

“The purpose of this law is to protect the public’s absolute right to breathe clean air.  This is not a ban, but rather a reasonable restriction on the use of these products in indoor public places,” stated Legislator Savage in remarks during the session.

The Legislature’s vote followed months of fact-finding, committee meetings, and public hearings in which several doctors, medical experts and public health organizations, including the Roswell Park Cancer Institute, the American Cancer Society, the American Lung Association, the Buffalo-Niagara Tobacco Free Coalition, the Wellness Institute of WNY, and the Commissioner of the Erie County Health Department warned of the dangers and risks that the emissions from Electronic Cigarettes and Vaping pose to the public’s health. The Legislature also heard from school officials and students at both the college and high school levels as to the growing use and popularity of Electronic Cigarettes and vaping by teens.
